Matthias Gottschalk, MBA (HSG), Attorney at law licensed in Switzerland and in Germany

Matthias Gottschalk, German citizen domiciled in Switzerland since 2005, graduated in law at the University Hamburg, Germany and successfully completed the first year of the J.D. program at the University of Tennessee, in Knoxville, USA. He was licensed as attorney at law in Germany in 1994 and received his admission to practise law in Switzerland according to Art. 28 BGFA in 2007. Having gained professional experience in the years 1995-2001 in various in-house-positions in law departments of different enterprises, including Universal Music, Matthias Gottschalk graduated successfully from as Executive MBA for media and communications at the business school of St. Gallen, Switzerland in 2003. From 2005 on, Mr. Gottschalk acted as Managing Partner for Maiwald Patentanwaltsgesellschaft (Schweiz) mbH in Zürich, which became by means of name change Gottschalk Maiwald Patent- und Rechtsanwalts- (Schweiz) GmbH in September 2016.

His main practise areas include legal consultation in intellectual property matters primarily for midsized enterprises in relation to German, Swiss and international intellectual property law. He focuses on the registration, enforcement and defence of Swiss, German and European Union Trademarks, Design rights and Copyrights, for instance in the course of opposition proceedings and related appeals and to represent clients in ip-related litigation. In addition, the practise areas of Matthias Gottschalk include Copyright, unfair competition law and drafting, negotiation and consulting in contract matters with a focus in licensing contracts, prior-rights-agreements and distribution, including online-distribution.

In recognition of a work regarding US copyright contract law, Matthias Gottschalk was awarded by the University of Tennessee, school of law, with the „Nathan Burkan Memorial Awards“ sponsored by ASCAP; He is Co-Author of the merchandising-law section of the „Handbuch des Film-, Fernseh- und Videorechts“ (Publ.v.Hartlieb/Schwarz). In 2015 Matthias Gottschalk had the honour to chair the AIPPI Switzerland working group on Q 246 „Exceptions and Limitations to copyright for libraries, archives and education and research organisations.”

Matthias Gottschalk acts currently as Secretary of the AIPPI Standing Committee on Copyrights; he publishes from time to time in AIPPI publications; Mr Gottschalk is enrolled member of the bar association (ZAV) in Zürich, Switzerland and the bar association in Munich, Germany (RAK München) and member at GRUR, INGRES, the Swiss-American Chamber of Commerce and the Swiss-German Chamber of Commerce.
