New digital technologies in the industry and their patentability
On May 30, 2018, GMP partners Dr. Walter Maiwald and Matthias Gottschalk, MBA (HSG) gave a lecture at the legal and steering committee of the German-Swiss Chamber of Commerce in Zurich entitled “New digital technologies in the industry and their patentability”.
Subjects of the lecture and the subsequent discussion were, inter alia, if the existing laws in Switzerland/Europe already grant protection for data generated and processed by autonomous systems, like drones, e.g. by means of copyright law, data protection law, trade secrets and/or patent law, or if such protection may be provided by new laws. One important subject, intensively discussed during the lecture, was the question whether users, which – for example by driving a car -, contribute to the generation of data, should be granted protective rights regarding such data or at least should be entitled to monetary compensation for the use and/or reselling of such data.
