Copyright, AI, and Digital Content

Texts and photographs are often protected by copyright, particularly against unauthorized reproduction. Using, for example, a photo or its associated image file in connection with AI training datasets generally requires the rights holder’s consent, as such use does not fall under the exception provided in Section 44a of the German Copyright Act (UrhG). While Section 60d UrhG does allow text and data mining without the rights holder’s consent, this applies only for the purpose of scientific research. Therefore, we always recommend clarifying the legal situation before any use.

Competition Law / Defense Against Cease-and-Desist Letters from Germany

Warning letters issued to Swiss companies from Germany are often based on trademark infringements or alleged violations of German competition law (UWG).
