A patent is granted upon application and following thorough examination, provided the invention is new, involves an inventive step, and is industrially applicable. Granted patents can be challenged through opposition proceedings or nullity actions. Patent law is the most economically significant area of intellectual property rights, which also include design rights and utility models.   <\/p>\n<p>In Germany, the <a href=\"https:\/\/www.dpma.de\/\" target=\"_blank\" rel=\"noopener\">German Patent and Trademark Office (DPMA)<\/a> in Munich is responsible for the examination and grant of national patents. In Switzerland, this task is handled by the <a href=\"https:\/\/www.ige.ch\/de\/\" target=\"_blank\" rel=\"noopener\">Swiss Federal Institute of Intellectual Property (IPI)<\/a>. Many patent applications from Germany and Switzerland\u2014both member states of the <a href=\"https:\/\/www.epo.org\/de\/legal\/epc\" target=\"_blank\" rel=\"noopener\">European Patent Convention (EPC)<\/a>\u2014are filed through the <a href=\"https:\/\/www.epo.org\/de\" target=\"_blank\" rel=\"noopener\">European Patent Office (EPO)<\/a>. Once granted, the Unitary Patent offers uniform protection across 18 participating EU member states. This is particularly attractive for companies seeking patent protection across multiple European jurisdictions.  <\/p>\n<p>Many patented inventions originate from employees, particularly in research and development. In Germany, the<a href=\"https:\/\/www.gesetze-im-internet.de\/arbnerfg\/\" target=\"_blank\" rel=\"noopener\"> Employee Inventions Act (ArbEG)<\/a> governs the employer\u2019s rights to claim and compensate such service inventions. We also advise extensively on this subject, for example, in drafting lump-sum compensation agreements.  <\/p>\n<p>The statutory basis of patent law is found in the <a href=\"https:\/\/www.gesetze-im-internet.de\/patg\/BJNR201170936.html\" target=\"_blank\" rel=\"noopener\">German Patent Act (PatG)<\/a> and in <a href=\"https:\/\/www.fedlex.admin.ch\/eli\/cc\/1955\/871_893_899\/de\" target=\"_blank\" rel=\"noopener\">Switzerland\u2019s Patent Act<\/a>, with the <a href=\"https:\/\/www.epo.org\/de\/legal\/epc\" target=\"_blank\" rel=\"noopener\">European Patent Convention (EPC)<\/a> forming the cornerstone of European patent law. <\/p>\n<\/div>\n<\/div><\/section><\/div>\n\n<style type=\"text\/css\"
